Warranties, Returns & Cancellations
Welcome to this page for terms,
conditions, and related info. We appreciate all your diligent efforts to
apprise yourself of the information needed to help make your auction experience
a happy one! With that said, I think it is a shame we have to have all this
stuff—but we do. Running a business today is not easy—and it’s nearly
impossible to please everyone all the time. However, I promise you, we will
truly endeavor to try!

WARRANTIES: Ok, brace
yourselves: We do not
provide warranties for any items we auction. We do not warrant guns will fire
or function properly, etc., or that all
parts or finishes of any gun are original. Buyer
assumes all responsibility for determining if a firearm is safe to shoot and
agrees to have gun checked by professional gunsmith before shooting it.
Now try to relax a little. We try
to do our best to carefully examine all firearms even before accepting them for
consignment. We also require our Consignors to affirm any details (they know
of) about their firearms, including highlights, flaws, defects, repairs,
modifications, shooting history, etc. Also, we most-times test for chambering,
ejection, trigger-pull, etc.—but not live firing (yet). We then pass along this
info in our auction descriptions. We don’t want our buyers to experience
unhappy surprises! If in doubt about something, we always err on the
conservative side. We play fair with our buyers, as well as our Consignors! Our
#1 goal is to have three smiling faces: The buyer, the Consignor—and (of
course) the Consignee (us).
RETURNS: Hang on for
other extreme wordiness to follow: We really
want you to be happy with your purchase and look forward to doing business with
us again! At the same time, we are also responsible to our Consignors who
provide us with their firearms—who also want to be happy. They rely on us to
expedite a sale for them. So, for all intents and purposes, we do not allow returns (unless we’ve made a
serious misrepresentation). Other exceptions are possible, but will be at our
discretion. In any event you must inspect firearms within 36 hours of delivery,
then contact us immediately before
you accept transfer from your dealer. In other words, if you accept
transfer—it’s yours! Also, if you should fail your NICS check for transfer,
you’ll have to work out reselling your gun with your dealer. For all (non-FFL)
items shipped directly to you, let us know immediately if there is a problem.
If we’ve made a serious
misrepresentation—it truly was not intentional, and we will try to make it right! If your dealer charges you for facilitating return
shipment, that’s between you two. The firearm must be returned unfired, in and
with all same packaging, with all same accessories, manuals, etc., and in same
condition as you received it (as our records will indicate). Also, we must
receive shipment within seven calendar days. You should also follow up with
your dealer about shipment, and we’ll try
to do the same. After receiving return shipment, we will need one or two
business days to inspect everything. Once we’ve verified that your
representations have been valid, we will issue a refund, less shipping—and our apologies.
Now, here is a serious scenario to consider: What if your purchase is
illegal in your area and/or your dealer refuses shipment? As we stated earlier
in the auction description, IT IS SOLELY YOUR
RESPONSIBILITY TO CHECK YOUR STATE & LOCAL LAWS REGARDING FIREARMS &
RELATED ACCESSORIES! We also check this, but we just
aren’t able to do it until we are ready for shipment. That means you’ve already
paid for it. It also means we have already incurred considerable expense of
time and money. Because of this, we will charge you a re-listing fee of 33%.
And, if an item inadvertently gets shipped to your dealer, but is refused,
you’ll also have to pay that expense. This event would cause us all a lot of
pain, so please be diligent about your legalities!
CANCELLATIONS: Because of
contractual obligations with our Consignors, if you win an auction—we’re not
allowed to cancel it! We are also required to process it to completion, based
(largely) on ours and GunBroker’s terms and conditions. However, we are allowed
to offer this (costly) alternative: We’ll issue you an invoice with a
corresponding 33% cancellation fee, that we must receive within 5 calendar
days. If paid, GunBroker won’t label you a non-paying bidder and we won’t leave
you negative feedback. GunBroker only allows a buyer 2 non-paying bidder
reports before they close your account!
Also, we reserve the right to cancel bids from buyers with
any negative feedback. We’re not saying this is automatic, but we are required
by our Consignors to be diligent in this matter. We also reserve the right to
cancel any auction if GunBroker’s website goes down within 24 hours of the
auction’s end. In this unlikely event, we will re-list auctions when website is
restored. This policy ensures all buyers have an equal opportunity to bid.
